Dear brother,
Before I ask a question, the back ground of the issue should be presented clearly. A couple was living in a non-Muslim country (China); they were married for 15 years, when they married, both of them had salary from their government job, but none of them had any savings, nor had estates. In the last 15 years, they did not separate their income, and jointly brought their all income to manage their family. In the last 7 years, the husband did a business in his spare time and was successful, from the business only, he was able to made around four million Chinese RMB (Chinese currency). The average salary of the local people is around 2000 to 3000 RMB. Muslims in China allowed having only two Children in that region. The couple, especially the wife, wanted to have more children, and risked for losing their house and jobs to have her third child, then again fourth child. Unfortunately, the wife passed away while she was giving birth to her fourth child at the age of 36. Compensation of one million RMB (RMB1000, 000) was given by the hospital due to some mistakes from the hospital. The family has two estates (apartment) and a car, together approximately worth RMB1000, 000 (one million RMB), and extended salary for deceased person from the government for 40 months around 100,000 RMB. Now altogether they have wealth of about 6 million and one hundred thousand RMB.
The couple has 4 children, and children currently are being taken care by their father. The couple was Muslim, especially the wife was a devoted Muslim who had never missed her Salah, whereas the husband only go to pray when Eid, and rarely for Jumah salah, and not regularly give Zakat. The deceased wife has both parents and they are alive, and the parents have wealth of approximately 200,000 RMB.
Now the wife passed away, and the couple has around 6 million RMB of wealth, which 4 million is come from the business from the husband, one million RMB of estates and car, one million RMB of compensation from the hospital (blood money), and extended salary for deceased person from the government for 40 months around 100,000 RMB. By the way, in China if the couple divorce, according to the Chinese law both the husband and wife divide their wealth equally to two, and both party gets the same amount of the wealth.
4000,000 RMB from business
1000,000 RMB from estate and car
1000,000 RMB from compensation from hospital
100,000 RMB extended salary for deceased person
Altogether, six million and one hundred thousand RMB
We know that the father and mother of deceased wife each inherit one sixth of the wealth of their daughter, this is not the question or confusion we have now. Now our question is what is (or how much is) the wealth of the deceased wife? Is the half of the family’s wealth (3 million RMB) considered the wealth of the deceased person? The last and main question is how much the both parents of the deceased person should inherit?
Thank you very much for helping us to clarify the confusion.
